General terms and conditions – Ex Altera Piercingstudio

1. General

These terms and conditions apply to all agreements, services and sales between the customer and Ex Altera ("the seller"). By making or confirming an appointment via e-mail (Fresha) or by telephone, the customer agrees to these terms and conditions. Deviations are valid only if confirmed in writing by Ex Altera.

• Nipple piercings are only placed from 18 years of age.

• Piercings in the pubic area or other strong health piercings will not be performed.

• We houden rekening met de deontologische code van piercers.

All piercings are placed according to the Royal Decree of 25/11/2005 on tattoos and piercings.

2. Prices

The prices listed on the website are indicative only and not binding. Only the prices displayed in the booking system (Fresha) or confirmed in writing by Ex Altera are binding.

3. Implementation and risk

• The appointment will start only after confirmation by the customer.

• After the piercing is placed, the risk of damage or loss passes to the customer.

• The goods delivered remain the property of Ex Altera until the invoice is paid in full.

4. Liability

• Ex Altera follows all legal hygiene and safety standards.

• Bodily damage due to improper use or aftercare is excluded from our liability, unless caused by Ex Altera's negligence.

• Defective goods or products are only covered by the manufacturer's warranty and must not have been used or processed.

Complaints about visible defects should be reported immediately after the service.

5. Payment

• Invoices are payable according to the stated payment term.

• Late payment will automatically attract statutory interest (12.5% per annum).

• On top of that, a lump-sum compensation according to the law of 4 May 2023 applies:

• • €20 for an outstanding amount ≤ €150

  • €30 + 10% of the balance between €150.01 and €500

  • €65 + 5% of the balance above €500, with a maximum of €2,000

In the event of late payment or loss of creditworthiness, Ex Altera reserves the right to collect outstanding invoices immediately or dissolve the contract, unless the customer provides payment guarantees in advance.

6. Absenteeism compensation

• Cancellation less than 24 hours before the appointment: 50% of the cost, with a minimum of:

  • €10 for appointments ≤ 30 minuten

  • €25 for appointments ≤ 45 minuten

  • €40 for appointments ≥ 60 minuten

• No-show: 100% of the cost, with the same minimum rates.

• These damages cover loss of time and income; Ex Altera can prove and claim higher actual damages.

• In case of force majeure, the client may reschedule the appointment free of charge. Ex Altera may request proof of force majeure, such as a medical certificate.

7. Disputes

• In case of irreconcilable disputes, Belgian law applies.

• The courts of Leuven have exclusive jurisdiction.

• Delivered goods remain the property of Ex Altera until paid for in full. In the event of the client's bankruptcy, these goods can be reclaimed.

8. Intellectual property

• All trademarks, logos, drawings, models, photographs and other materials remain the property of Ex Altera or the manufacturer.

• Use, reproduction or modification by third parties is not allowed without written consent.

• Photos and videos of piercings performed may be used commercially after written approval from the customer.A consent form will be completed before any piercing is placed
